Terms of Use and Service

These Terms of Use and Service constitute an agreement between the Wharton County Sheriff's Office and the User for access to and use of this training platform.

1. Parties

The parties to this agreement are the Wharton County Sheriff's Office, including its Law Enforcement Training Center and related training operations, and the individual creating or using an account on this platform, referred to in these terms as the User.

2. Purpose of the Service

This platform is provided to support training registration, course participation, recordkeeping, communication, transcripts, certificates, and other related administrative and instructional functions. The User may use the platform only for lawful and authorized training-related purposes.

3. Eligibility and Account Responsibility

By creating an account, the User represents that the information provided is accurate, current, and complete. The User is responsible for maintaining the confidentiality of account credentials and for all activity conducted through the account. The User must promptly update account information when changes occur.

4. Acceptable Use

The User agrees not to misuse the platform, interfere with its operation, attempt unauthorized access, submit false or misleading information, impersonate another person, or use the service in any manner that violates applicable law, policy, or training rules. The Wharton County Sheriff's Office may suspend or terminate access for misuse or suspected misuse.

5. Training Records and Communications

The User understands that information submitted through the platform may be used for course registration, roster management, attendance tracking, testing, critiques, certificates, transcripts, internal reporting, and operational communications related to training services. The User is responsible for reviewing platform notices and maintaining a valid email address for account-related communication.

6. Privacy and Data Handling

The Wharton County Sheriff's Office will use information collected through the platform for administrative, operational, legal, and training-related purposes. While reasonable measures may be used to protect system information, no electronic service can be guaranteed to be completely secure. The User acknowledges and accepts the inherent risks associated with electronic systems and internet-based services.

7. Intellectual Property and System Access

All platform content, workflows, documents, and system materials made available through this service remain the property of the Wharton County Sheriff's Office or its licensors unless otherwise stated. Access to the platform is limited, revocable, and non-transferable. No ownership rights are granted to the User by use of the platform.

8. No Guarantee of Availability

The service may be modified, interrupted, restricted, or discontinued at any time without prior notice. The Wharton County Sheriff's Office does not guarantee uninterrupted access, error-free operation, or continued availability of any specific function, page, or feature.

9. Disclaimer of Warranties

The platform and related services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. The Wharton County Sheriff's Office disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

10. Limitation of Liability

To the fullest extent permitted by law, the Wharton County Sheriff's Office shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the platform, inability to use the platform, system interruptions, data issues, or reliance on information obtained through the service.

11. Compliance with Policies and Law

The User agrees to comply with all applicable laws, regulations, agency policies, training requirements, and posted platform procedures. If the User is accessing the system on behalf of an agency or employer, the User remains responsible for ensuring that such use is authorized.

12. Modification of Terms

The Wharton County Sheriff's Office may update these Terms of Use and Service at any time by posting a revised version on the platform. Continued use of the service after such changes constitutes acceptance of the revised terms.

13. Termination

The Wharton County Sheriff's Office may suspend, restrict, or terminate the User's access at any time, with or without notice, for security reasons, operational reasons, violation of these terms, or any other reason deemed necessary for administration of the service.

14. Governing Understanding

By creating an account or using this platform, the User acknowledges that the User has read, understood, and agreed to be bound by these Terms of Use and Service between the Wharton County Sheriff's Office and the User.
